GOH: Court Rules Against IL Wiretapping Law

In the past we've discussed how three states, Massachusetts, Maryland, and Illinois, all have laws in place that ban you from filming police officers. But there's been a growing opposition in Illinois to reverse that law, even though it has been in place since the 60s. Under their eavesdropping law, people are prohibited from recording audio of public conversations without consent of everyone involved. It's a class one felony if you violate the law, and that could come with a 15 year prison sentence. More and more people are calling on the state to reverse the eavesdropping law. And in Chicago, officials have already announced they won't be enforcing it during the NATO summit later this month, a move that's been cheered by protesters.

Arrested for Filming Police in MD?

An individual in the US state of Maryland is facing felony charges for filming and posting online a video of an aggressive unmarked police officer pulling him over for speeding. Yahoo StumbleUpon Google Live Technorati del.icio.us Digg Reddit Mixx Propeller Anthony Garber was pulled over while on his motorcycle by a non-uniformed police officer driving an unmarked car. The officer got out of his car, pulled his gun and aggressively approached Garber before identifying himself as state police. Garber recorded the incident with a camera that was attached to the top of his motorcycle helmet and posted it on YouTube. Days after posting the video online the police showed up at Garber 's home and arrested him for violating the state's wiretapping laws. It is illegal in Maryland to video tape anyone without their consent. "It's obviously an attempt by the police to strongarm him. He did nothing wrong. He did nothing criminal. All he did was expose a cop, an overly aggressive cop, and he embarrassed a cop and now they're cracking down on him. It's really out of line on the police department for pursuing this charge against him because the wiretapping law is meant for telephone conversations, not for being videotaped in public when you have no expectation for privacy," said blogger Carlos Miller of Photography Is Not A Crime. Maryland Man Could Face 16 Years in Jail for Videotaping Traffic Stop A twenty-five-year-old staff sergeant for the Maryland Air National Guard is facing up to sixteen years in prison for uploading a video on YouTube that showed an undercover police officer pulling a gun on him during a traffic stop. Anthony Graber was initially ticketed for speeding, but once he posted the video, the state charged him with four felonies, including violating Maryland's wiretap law. State police officers also raided Graber's parents' home and confiscated his camera, computers and external hard drives. Graber is one of many Americans facing possible jail time for videotaping police activity. Last week Democratic Congressman Edolphus Towns of New York introduced a non-binding resolution calling for the protection of citizens who videotape cops in public from getting arrested on state wiretapping charges.

Citizen's Rights - Plainclothes State Trooper Pulls Out Gun On Motorcyclist

He was later charged with 4 felonies for breaking Maryland's wiretapping law for posting this video on YouTube...clearly a misapplication and misuse of the law.

'A militarization of US police'

US police have waged war, not on drugs but on video recording devices. Do Americans stand a chance when it comes to watching the watchmen? Radley Balko, Senior Editor for Reason Magazine says Congress or State Legislatures need to pass laws making this explicit, that you have a constitutional right to record government officials in public while on duty. US police state in full focus

Most cell phones these days have cameras on them; as a result American police are lashing out and confiscating cameras or arresting people recording them. Is this the start of a police state in the United States?
