Soldiers have a duty to fight and conduct themselves as professionals. These men are not soldiers, simply thugs with guns in a uniform. They deserve no consideration when confronted by real soldiers. Soldiers under command take prisoners and treat them humanely, no executions, no torturing prisoners or denying them food/water.
